The BJP has formally petitioned the Election Commission of India to take action against Wadettiwar, a prominent campaigner for the Congress, and the Congress party itself for propagating falsehoods.

Praveen Shankar Kapoor lodged the complaint, who is the media head of BJP’s Delhi unit, before Additional Chief Metropolitan Magistrate Tanya Bamniyal, who posted the matter for recording pre-summoning evidence on May 4.

Vijay Mishra filed the case on August 4, 2018, in response to remarks Gandhi allegedly made against Home Minister Amit Shah at a press conference in Bengaluru on May 8, 2018, during the Karnataka elections. 

“In addressing a democratic community, it is crucial to emphasise that freedom of speech, while a fundamental right, does not grant individuals the licence to inflict harm or tarnish the reputation of others,” the high court stated.
